BASIS-32® WebScore Terms and Conditions for Use
 
The BASIS-32® is a patient self-report rating scale of symptom and problem difficulty, used primarily to assess outcomes of treatment. It is designed to be given by a qualified health care provider or his or her qualified representative at the beginning of a treatment episode to serve as a baseline assessment of the patient's perspective of his/her own symptoms and problems. BASIS-32® can then be given by a qualified health care provider or his or her qualified representative at discharge or at a time point during treatment to assess improvement in symptom and problem difficulty from the patient's perspective. Improvement is ascertained by comparing scores at intake with scores at discharge or other second time point.

Decreases in self-reported symptom and problem difficulty are one measure that may indicate some improvement. However, BASIS-32® is not a clinical diagnostic tool and it is not designed to replace a clinical evaluation; accordingly, a provider should fully evaluate any patient and not rely on survey results to make a clinical diagnosis. BASIS-32® is one measure of how patients perceive their own symptoms and problems and may be used together with other indicators to identify goals for treatment based on patients' symptom and problem identification.

Once a survey is completed and a qualified health care provider or his or her representative submits the data to the BASIS-32® WebScore service, it will perform the calculations to obtain BASIS-32® subscale and overall mean summary scores. The scores are then displayed on your computer screen and may be printed. The WebScore service does not store the data in a file or transmit the data to McLean Hospital.

BASIS-32® data entered through WebScore ARE NOT SECURE during transmission. In entering data through WebScore you will be sending patient information over the Internet to be scored. Consequently, it might be possible for other people to see what you are sending. YOU DO NOT NEED TO ENTER PERSONALLY IDENTIFIABLE PATIENT INFORMATION (names, numbers, etc.) on WebScore for the BASIS-32® for it to be scored, and we strongly recommend that you do not include such information. If you choose to do otherwise, you will be solely responsible for any liability arising out of such transmission.

The information contained and generated in these materials is not intended nor implied to be a substitute for medical diagnosis or treatment or for professional medical advice. Permission to reproduce these materials is strictly prohibited, unless prior written consent is obtained from McLean Hospital.

Once your subscription has been paid, you shall have the non-exclusive, nontransferable right to use the BASIS-32® WebScore supplied to you by The McLean Hospital Corporation ("McLean") on the following terms and conditions:

1. Your subscription permits you to enter, score, and print BASIS-32® results from the BASIS-32® WebScore for internal purposes (e.g., outcome assessment, quality improvement, and performance measurement of patients treated at your facility ) at your BASIS-32® licensed facility in accordance with the accompanying instructions.

2. You agree not to adapt, translate or otherwise modify the content or phrasing of BASIS-32® and BASIS-32® WebScore in any manner. You will ensure that McLean’s copyright and trademark notices and any other notices included by McLean appear on all copies of BASIS-32®; that you reproduce for purposes of this scoring.

3. BASIS-32®; and BASIS-32® WebScore are provided to you on an "as is" basis. BASIS-32®; WebScore does not store data transmitted to it for scoring. McLean makes no representations regarding BASIS-32®; 's and BASIS-32®; WebScore's validity, reliability or other characteristics. MCLEAN DISCLAIMS ALL WARRANTIES WHETHER EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NONINFRINGEMENT. You release McLean, its trustees, appointees, employees and agents from any liability in connection with the use of BASIS-32®; , BASIS-32®; WebScore, or any derivative thereof by you, and you agree to defend and indemnify McLean and its trustees, appointees, employees and agents from any and all claims and damages in any way arising from the use of BASIS-32®; or any part thereof by you or your representative(s).

4. You will not take any action which would destroy or diminish McLean's rights in the BASIS-32®; trademark, or use the BASIS-32®; trademark, or any mark or name confusingly similar thereto, for any purpose not previously authorized in writing by McLean. You agree to cooperate with McLean in preserving the goodwill in the BASIS-32®; trademark. You agree that you will not use the name or logo of McLean or of any employee, staff member, or agent of McLean in any advertising, promotional material or publicity without the prior written approval of the party or person whose name or logo is to be used.

5. Your subscription to BASIS-32®; WebScore is for one calendar year, renewable for successive years. If you do not renew your subscription you will no longer have access to BASIS-32®; WebScore.

6. McLean may terminate your subscription at any time if you have breached any obligation to McLean (including these terms and conditions) under your subscription agreement, and have failed to cure that breach within thirty (30) days after McLean notifies you of the breach.

7. Your subscription agreement, including these terms and conditions, shall be construed and interpreted according to the substantive laws of Massachusetts, regardless of the choice of law rules of any jurisdiction.

8. If you disagree with these Terms and Conditions for Use, you may cancel your WebScore subscription and receive a refund if requested within 15 days of WebScore registration.
